Welcome to lalecosmetics.com (the "Site"), operated by LALE Cosmetics LLC ("LALE," "we," "us"). By accessing or purchasing from the Site, you agree to these Terms.
1. Eligibility
You must be 18 years of age or older to purchase from the Site.
2. Products, pricing & availability
- We describe our products as accurately as possible. Actual color may vary slightly by screen.
- Prices are in USD and may change without notice. We may correct errors, and cancel or limit orders (including for pricing errors or suspected fraud).
- Products are subject to availability.
3. Cosmetic product use & disclaimer
LALE products are cosmetics. The Luxe Gloss is an OTC sunscreen drug and carries a Drug Facts panel. Use only as directed on the packaging. Discontinue use if irritation occurs. Perform a patch test if you have sensitive skin or known allergies. Our product descriptions relate to the appearance of lips and the peri-oral area and are not medical advice and not a substitute for professional care. Consult a physician or dentist for any medical concern.
4. Orders & payment
Placing an order is an offer to buy. Your order is accepted when we send a confirmation or ship. Payment is processed by our payment provider at checkout.
5. Promotions & discount codes
Discount codes and promotional offers are limited to one per order unless stated otherwise, cannot be combined, and cannot be applied to prior purchases. We may modify or end a promotion at any time. Purchases made with a promotional code or during a sale are final sale, as described in our Refund & Return Policy, except orders placed with the welcome code for new email subscribers.
6. Shipping, returns & refunds
Governed by our Shipping Policy and Refund & Return Policy, incorporated by reference.
7. Intellectual property
The Site and its content, including the LALE name, logos, product names, packaging designs, text, images, and other branding, are owned by or licensed to LALE and protected by law. Don't use them without our written permission.
8. Acceptable use
Don't misuse the Site, attempt to breach its security, scrape it, or use it unlawfully.
9. User content
If you post reviews or other content, you grant us a non-exclusive, royalty-free license to use it in connection with the business, and you confirm it's yours to share and not unlawful. We may remove content that violates these Terms.
10. Disclaimers & limitation of liability
The Site and products are provided "as is" to the fullest extent permitted by law. To the extent permitted by law, LALE is not liable for indirect or consequential damages, and our total liability for a product is limited to the amount you paid for it. Nothing limits liability that cannot be limited by law.
11. Indemnification
You agree to indemnify LALE against claims arising from your misuse of the Site or violation of these Terms.
12. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Riverside County, California, and you consent to the jurisdiction of those courts.
13. General
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, are the entire agreement between you and LALE regarding the Site.
14. Changes
We may update these Terms. Continued use means you accept the changes.
